Maximising the full potential of your property begins with a consultation with a Conveyancer and Land Surveyor to determine the viability of opening a sectional title register or subdivision. Opening a sectional title register requires no advertising, no neighbours’ consent and is much quicker to finalise.

The Land Surveyor will consider by-laws/land use regulations and zoning. After perusal of all the applicable title deeds, the Conveyancer will issue a certificate confirming that there are no title conditions that prohibit sectionalisation of the property. The Conveyancer will also advise what notices should be given to any tenants.

The Land Surveyor will demarcate the sections, exclusive use areas and common property on the sectional diagrams. The Land Surveyor will also advise if the building plans need to be updated.

Once the concept diagrams have been drafted, marketing of the section/sections can begin as approval at the Surveyor General can take between 6 to 8 weeks. Lots of time to find a buyer!

An offer to purchase to sell one of the sections can be signed before approval of the diagrams has been received from the Surveyor General. There are, however, many considerations to be taken up in the Offer to Purchase. Once again, your Conveyancer is key.
